Court ordered sale of valuable Real Estate at Public Auction

Terms of Sale: Terms of sale are: Cash or Cashier's Check. There willbe $2,500 deposit down on the properties located at Morning Star Road and Batman Road; there will be a 10% deposit down for all other properties, on the day of sale, with the balance due upon delivery of Deed within 30 days at closing. Each lot shall be sold separately. The sale is subject to confirmation by the Circuit Court of Page County, Virginia: Hearing on confirmation of the sale will be held at 9:00am, or as soon therefore, on October 14, 2009. If the sale is confirmed by the court, then Settlement shall be held within 30 days after the date of sale, that is, by November 14, 2009, unless otherwise postponed at the sole discretion of the Special Commissioners. Sale is subject to the covenants, conditions, restictions, rights of way, and easements, if any, contained in the deeds forming the chain of title to the property. The Property is sold AS IS. Time shall be of the essence with respect to settlement. The deposit shall be applied to the credit of successful bidder at settlement; or, in the event of failure to complete settlement within the time set forth after the date of sale, in accordance with the terms of sale, the deposit shall be forfeited and applied to the costs of sale, including Special Commissioner's fees, and the property shall be resold at the cost and expense of the defaulting Purchaser, who sahll remainliable for the full purchase price, less net proceeds of any re-sale. Current real estate property taxes will be prorated at closing.
